Terms of Use

The MedicAlert Foundation® Terms of Use document is made available for you to read carefully as a user of our PrEMISE® service.

We expect that all healthcare professionals using the PrEMISE® service to keep information contained in the PrEMISE® app confidential and to comply with all applicable laws including HIPAA and any other state and federal laws relating to safekeeping of confidential information.

MedicAlert Foundation® PrEMISE® Terms of Use

This access agreement is between MedicAlert Foundation® and you (the registrant of its Emergency Medical Information Service). Registrants may include licensed physicians, nurses, EMT or other healthcare professionals.

Emergency Medical Information Record

The Emergency Medical Information Record (EMIR®) contains member provided information and you acknowledge and agree that MedicAlert Foundation is not responsible for inaccurate or outdated medical history. The medical information is not to be used as a substitute for the licensed healthcare professional's clinical judgment.


You agree to comply with all applicable laws including HIPAA, and other state and federal laws relating to maintenance of privacy, security and confidentiality, as regards to the EMIR® and other MedicAlert Foundation® member information accessed from PrEMISE® or otherwise from MedicAlert Foundation. You agree to access PrEMISE® only for your patient who is a MedicAlert® member whom you are providing treatment at a time of emergency.

Authorized Use

You agree that you are the person registering and using MedicAlert's PrEMISE® Any attempt to falsify your identity in the registration process will result in the termination of your access to PrEMISE® and other MedicAlert Foundation® information concerning MedicAlert Foundation® members, in addition to any other criminal, civil, or regulatory claims and proceedings that may be warranted.

Information that You Provide to MedicAlert®

When you enter your personal information into the PrEMISE®, MedicAlert Foundation® pledges to protect your information. See MedicAlert Foundation's Privacy Policy. You agree to keep your registration information current with MedicAlert®. This registration information may include your license or certifications, the states and facilities for which you are authorized to provide care.

Audit Trail

You understand that when you use MedicAlert's PrEMISE® Service, to gain access to a member's medical record, an audit trail will be recorded. The audit trail will include your Login Name, Time of Access, IP address, Facility Name, MedicAlert's member identification number, and the name of the member whose medical record was accessed. Termination You agree that your account and your access to MedicAlert® PrEMISE® and EMIR® and any other information concerning MedicAlert Foundation® members may be terminated at any time for any reason, with or without notice and with or without cause.

Acceptance Procedure

By accessing MedicAlert's PrEMISE® you are conclusively communicating your agreement with all the terms and conditions contained in this Terms of Use agreement.
